Please read these Terms of Service carefully before placing an order or using our website. By accessing our store or placing an order, you agree to be bound by these terms.
1. About Us
Porth Shore is an independent creative studio based in Cornwall, UK. We create and sell original artwork, limited edition prints, and products inspired by our love of the ocean. We can be contacted at wasson@porthshore.com.
2. Eligibility
By using this website, you confirm that you are at least 18 years of age, or that you have the consent of a parent or guardian. Our products are intended for personal use and enjoyment.
3. Products
Physical products We offer original artwork, limited edition prints, t-shirts, and other products. Some items are produced by carefully vetted print on demand partners as part of our commitment to environmental responsibility - producing only what is needed.
Original artwork is one of a kind. Once sold, it will not be reproduced or re-listed. Product images are as accurate as possible, however colours may vary slightly depending on your screen settings and the nature of handmade work.
Commissioned & personalised artwork Commissioned pieces are created upon a specific, themed request. While customers may specify preferences, ultimately, the look of the piece is down to the artistic direction of the creator. Art is made by artists, and, should you request a commission, this will be fulfilled by the artist in their style and according to their vision and personal expression of the requested theme. By placing a commission order you confirm that you have read and agree to the commission terms set out in our Refund, Returns & Cancellation Policy, including the deposit and cancellation structure.
Digital downloads Where digital products are available (such as downloadable prints or artwork files), these will be clearly marked. By purchasing a digital product and proceeding to download, you expressly consent to the download beginning immediately and acknowledge that you thereby waive your 14-day right to cancel under the Consumer Contracts Regulations 2013. Refunds will not be issued for digital products once downloaded, except where the file is faulty or materially not as described.
4. Pricing & Payment
All prices are displayed in GBP (£) and are inclusive of any applicable taxes unless otherwise stated. We reserve the right to change prices at any time. The price you pay is the price displayed at the time of your order.
We accept payment via the methods displayed at checkout. Payment is taken in full at the time of order, with the exception of commissioned artwork where a 50% deposit is taken upfront in accordance with our commission terms.
5. Discount Codes & Gift Cards
Discount codes must be applied at checkout and cannot be applied retrospectively. Only one discount code may be used per order unless otherwise stated. Discount codes have no cash value and cannot be exchanged for cash.
Digital gift cards are delivered by email and can be used as full or part payment at checkout. Gift cards cannot be exchanged for cash, refunded, or replaced if lost. Gift cards are valid for 2 years from the date of purchase.
6. Orders & Fulfilment
Once your order is placed you will receive an order confirmation by email. This confirmation is an acknowledgement of your order, not an acceptance of it. We reserve the right to cancel or refuse any order at our discretion, in which case a full refund will be issued.
Estimated delivery times are provided in good faith but are not guaranteed. We are not responsible for delays caused by third party couriers or print on demand partners once an order has been dispatched.
7. Cancellations, Returns & Refunds
Our full Cancellations, Returns & Refunds policy is set out separately and forms part of these Terms of Service. Please read it carefully before placing your order.
8. Intellectual Property
All artwork, designs, images, and content on this website are the intellectual property of Porth Shore and its creator, unless otherwise stated. Nothing on this website may be reproduced, copied, distributed, or used commercially without our express written permission.
Purchasing a physical or digital product does not transfer any intellectual property rights to the buyer. You may not reproduce, print, or sell our designs or artwork in any form.
Porth Shore's intellectual property may not be used for AI training purposes, data mining, or reproduction by AI platforms or services in the production of supposedly 'new' products or designs that have been lifted from our work. We expressly reserve all rights in this regard under applicable copyright law.
Under the Artist's Resale Right Regulations 2006, the creator of original artworks retains the right to a royalty upon any qualifying resale of their work through art market professionals. This right cannot be waived. Buyers of original artwork are advised that this right applies and that resale royalties may be due to the artist upon any subsequent qualifying sale.

9. Limitation of Liability
To the fullest extent permitted by law, Porth Shore shall not be liable for any indirect, incidental, or consequential loss arising from the use of our website or products. Our total liability to you shall not exceed the value of the order in question.
Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Governing Law
These Terms of Service are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated date. Your continued use of the website after any changes constitutes your acceptance of the new terms.
